Creative license: with a little help, a mompreneur develops a bedding line for kids.

WHEN BEVERLY SUTHERLAND, FOUNDER AND PRESIDENT of Los Angeles-based ABC Kidz Designs Inc. decided to launch a juvenile bedding line, she incorporated an idea into her business plan that startups often overlook--the licensing deal.

"I called the Negro League Baseball Museum's licensing group and got a great opportunity to meet with their executive director, Don Motley," says Sutherland, 42. "He was very excited about my idea." A licensing contract is a legal agreement that gives a company the right to use another firm's patent or trademark in return for http://shop.nordstrom.com/c/baby-bedding a share of the revenues generated from product sales.

Sutherland launched Afro-Babies, now ABC Kidz Designs Inc., and the Negro League Baseball Collection in late 2005. The company grossed $100,000 within a year, and just over $200,000 in 2007. Then, last month the entrepreneur launched a Major League Baseball line through a licensing deal with that league. She expects to see gross revenues of $700,000 by the end of this year and $5 million by the end of 2009.

"Beverly's business model is brilliant," says Steven Rogers, professor of entrepreneurship at Northwestern University's Kellogg School of Management. But he warns that typical licensing agreements may be too financially burdensome for some.

Most companies with established brands require a fixed fee up front (usually http://www.babysupermall.com/crib-bedding.html negotiable, fees can range from a few thousand dollars for a smaller brand to hundreds of thousands of dollars for a major http://dinosaurcribbedding.info/ brand). Licensors also receive a percentage of the revenues generated from product sales (typically 5% to 15%). In addition, Sutherland spent $100,000 in startup costs for market research, product development, initial inventory, samples, and adjustments--a massive undertaking for the Englewood, California, native and her team of vendors. "I should have been nervous," she says, laughing. "But, I really believed in the company and the market we were participating in."

Sutherland's business is positioned for continued success: The juvenile textile business is a growing $8.9 billion industry, and sports licensed goods took in an estimated $19.3 billion last year alone. Says Sutherland, "If we were to have started this business on our own, without a recognized entity like Negro League Baseball, then maybe the results would have been different."

BEFORE YOU SIGN ON THE DOTTED LINE...

"Licensing can give a small business the leverage of a larger, stronger brand," says intellectual property attorney Nia J.C. Castelly of Pryor Cashman L.L.P. in New York City. However, signing the wrong deal can be risky and may not automatically translate into financial gain for the licensee. The right lawyer can help protect your company and ensure that your licensing deal is as financially beneficial to your business as possible. "Consult an attorney who has experience protecting intellectual property rights, defending against infringement claims, and negotiating intellectual property transactions," Castelly suggests.

The Chattanooga area seems to be finding its way slowly out of the property depression. Again Chattanooga home sales has outpaced us and particularly the southeast U.S. In accordance with the Multiple Listing Service (MLS) in the greater Chattanooga Association of Realtors. Unit sales improved into positive territory, this appears to be an explicit sign of local improvement. In May, Southeast Tennessee and the Northwest Georgia area saw the sale of 485 residential units, a.2% increase in comparison with just the previous month, including a 23% drop from a year ago this time.

Chattanooga home sales are capable of outpace much most of US as a result of many positive economic factors happening locally. The Chattanooga housing market just needs some help from other parts of the economy based on most realtors we spoke to. They feel the lenders have money but with a 20% down payment requirement for most purchases they have made it hard to see a real rebound in the housing market. Many we spoke to said potential buyers had wait longer for their credit score to go up or saving for a larger down payment so they could purchase a new home even within the Chattanooga home market. We see people with good credit and excellent jobs unable to obtain the down payment to make a purchase that a few years ago they'd have been in a position to take advantage of.

Real estate contracts 201 | Examiner.com

Ok everyone, take out your notebooks, laptops, tablets, etc. and http://www.homefinder.com/ get ready for today's topic which is Real Estate Contracts 201. Professor K would like to welcome all of you back from the holiday weekend. Hopefully by now your hangover is in remission and your heartburn has abated after downing all of those hamburgers and hotdogs loaded up with pickles, relish and sauerkraut at the Memorial Day barbecue. The prerequisites for this class are to have either completed Contracts 101 or you may substitute experience from buying or selling a property in Incline Village or Crystal Bay. We are assuming that you have already acquired the basic knowledge of Nevada real estate contracts along with a general understanding of the purpose of IVGID and the TRPA. So, this class will focus on some of the nuances that will help you to write a better real estate purchase agreement. While the standard Incline Village Board of Realtors purchase agreement is 11 pages long and fairly comprehensive, there are some additional provisions that you may wish to include in your next transaction.

The easiest way to do this is to create a separate addendum that will generally be one or two pages long containing the additional items that you want to address. When a buyer presents a purchase agreement to a seller there will generally be at least one or more counter offers going back and forth between the parties. Therefore, it's impossible to predict on the day that you submit an offer to a seller exactly when an agreement will be reached. That means contingency removal deadlines could potentially fall on a weekend or legal holiday. This would not be a problem if everyone worked seven days a week all year round, but that is not the case especially for banks, title companies and the County recorder. An easy solution to the problem of deadlines falling on a weekend or legal holiday is to insert the following language into an addendum to the purchase agreement. If the date for any obligation stipulated in this Agreement should fall on a Saturday, Sunday or Federal Legal Holiday, then said obligation stipulated in this Agreement shall be performed on the next business day. The only exception to this term is that the expiration for the response to this offer and any and all counter offer(s) shall be on or before the time and date stated in this offer and any and all counter offers. By utilizing the language in the paragraph above, buyers don't have to worry about needing to botanique at bartley ask for an extension in the event that the deadline for say the loan contingency removal or the close of escrow falls on a weekend or legal holiday. The deadline will simply move to the next business day making it much easier to keep the transaction flowing smoothly and without the need to generate additional paperwork or ask the seller for an extension of time to complete the task at hand. Have you ever given someone a check and they misplaced or lost it?

There are times when the physical inspection report will turn up concerns regarding the roof, water intrusion, structural issues, etc. Buyers can protect themselves by adding this provision while giving the seller confidence and assurance that the inspection process will not be strung out beyond the originally agreed upon contingency removal date. I hear the bell ringing, so that concludes today's class on Real Estate Contracts 201. We have only scratched the surface. Depending on the particular circumstances of any given transaction there may well be other special provisions that you will want to put into the addendum of your next purchase agreement. Consult your attorney if you have any questions or concerns about a real estate purchase agreement or adding any provisions to an addendum that modifies the standard documents used in transactions in Nevada.
